Dr. Javaid Perwaiz, a Chesapeake, Virginia, obstetrician-gynecologist, has been accused of performing unnecessary surgeries and procedures on dozens of women. In addition to facing criminal charges, Dr. Perwaiz will also face civil lawsuits from patients who allegedly underwent unnecessary operations or suffered other types of medical malpractice.

In June 2020, a federal grand jury returned a 62-count indictment against the doctor, charging him with making false statements related to healthcare matters, healthcare fraud, and aggravated identity theft. The indictment alleged that between 2010 and 2019, Dr. Perwaiz billed insurance companies over $2.3 million for gynecological care that was, in part, justified by procedures he never actually performed.

Dr. Perwaiz is currently on trial, which is expected to last up to five weeks. He pleaded not guilty. During testimony, Lisa Strong, who worked for him, said she observed him pretend to perform procedures with broken equipment, submit bills to insurance companies for work he had not completed, and record false information on patients’ charts to justify unneeded hysterectomies and other medical procedures, according to the articles in the Washington Post and Virginian-Pilot.

Prosecutors told jurors that, for years, Dr. Perwaiz performed unnecessary surgeries on patients so that he could bill insurers and fund his extravagant lifestyle. Assistant U.S. Attorney Rebecca Gantt said many pregnant patients were induced so Dr. Perwaiz could be the one to deliver the baby and bill for it.

Dr. Perwaiz performed over 500 surgeries on Medicaid patients between January 2014 and August 2018.

In addition to these criminal charges, Dr. Perwaiz may have committed civil torts against patients. Before a surgeon operates, informed consent has to be obtained. If a patient had a surgical procedure they did not know about, the doctor could be held liable, and the patient may be entitled to compensation. Also, if a patient is not fully informed about the nature of a medical procedure, such as its potential risks, this may also lead to a civil lawsuit.
